1. Services & Session Policies Scope of Work: We provide professional headshot sessions, portfolio photography, and professional video headshots.Session Experience: To ensure the highest image quality, sessions do not carry strict clothing change limits or rigid time parameters.Booking and Retainers: Photo sessions must be booked through our approved calendar channels. We reserve the right to request a non-refundable deposit to secure appointments.Cancellations & Rescheduling: Clients must provide at least 48 hours' notice to reschedule a session. Cancellations without timely rescheduling may result in a forfeiture of the retainer.

2. Intellectual Property Rights & Image LicensingCopyright Ownership: Unless otherwise specified by written contract, Mark Denney Headshot Photography retains full statutory copyright ownership of all raw and edited images captured during any session.Client Usage License: Upon final payment, clients receive a non-exclusive, perpetual, personal-use license to use their purchased images. This includes high-resolution file formats and pre-sized copies for social platforms like LinkedIn.Commercial Restraints: Clients may not resell, license, or sub-license the images to third-party commercial entities without express written consent.Website Content: All website code, text, graphics, designs, logos, and layouts on the Site are owned or controlled by us and protected under international copyright laws.

3. Image Delivery & RetentionDelivery Timelines: Final edited digital images are typically delivered via an electronic gallery link within 2 to 3 days post-session.Gallery Lifespan: Digital delivery galleries are hosted for a minimum of 90 days following the delivery date. It is the client’s sole responsibility to download and backup their high-resolution assets within this window.

4. Prohibited ActivitiesYou may not access or use the Site for any purpose other than that for which we make it available. Prohibited activity includes:System Abuse: Sneaking, scraping, data mining, or using automated tools to extract site content.Malicious Behavior: Introducing viruses, trojans, logic bombs, or disabling site security architecture.Misrepresentation: Impersonating another user, attempting to commit fraud, or providing false booking credentials.

5. Limitation of LiabilityIn no event will Mark Denney Headshot Photography or its operators be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, or punitive damages, including lost profit or lost data arising from your use of the Site or our photographic services. Our maximum liability under any circumstances will be limited to the total fees paid by you for the specific photography session in question.
